Plaxico Burress aka Cheddar Bob gets 2 years

I get that if you commit a crime, however stupid, you have to be punished, but this punishment just doesn't match the crime. There are pedophiles, drug dealers, and drunk drivers that get less time than Cheddar Bob (if u haven't seen 8 mile, please do so). Plax didn't have any intentions of committing a crime and probably didn't even realize he was committing a felony just by carrying, whether the gun was ever fired or not. I know ignorance is no excuse, but don't you think the humiliation he suffered was enough! I mean, he shot himself in the leg and is now going to jail because of it. There has to be another punishment we can give stupidity w/o intent. The justice system is too busy trying to make an example out of people and it's ridiculous. We have more black men in prison then we have in college, and now Plax becomes just another statistic.

Logic does say, if he was dumb enough to shoot himself he was dumb enough to shoot someone else or get himself killed, and I agree, but thankfully he didn't shoot anyone else. Plaxico is now going to have 2 years, 730 days, 17,520 hours, to sit and think about the fact he is in a cell because he wasn't smart enough to not only know the laws of weapons carrying in NY, but also for not being capable of working a safety. I guess that plea deal he was offered in the beginning is not looking so bad.



My final thoughts are this, yes as athletes, sometimes we wanna go out and have a good time. Alot of us like to be the life of the party, pop bottles in VIP and party the night away, but going to a place where I feel I have to carry a gun to be safe, is not fun for me, and probably a place I don't need to be. If it's my life vs some hot chicks and bottle poppin', I'm gonna take my life everytime!! I'm with my man Esteban Ocho Cinco, from now on, the only partying I'm doing is at Club G3, aka, my house!!!

  I can't believe it, Stallworth kills a man and Plax gets 2 yrs. I just heard this a short while ago and it's BS. A mayor got his wish, nothing but a phony grand standing politician. The only guy Plax hurt was himself. He should have gotten a stiff fine and very tough probation terms as well as community service, most walk for this crime with nothing more than that. But I will admit he put himself in this position, so he has to face the music. It's just a really sour cord.

  don't forget that punitive measures aren't just meant to punish the wrongdoer, but to deter others from committing the same crime.
  but i'm with speed. it's not just like they spin a wheel to determine the sentence. laws should be the same for everybody. he coulda done a little research and realized that the risk he was taking wasn't worth it.

  2 years is 2 years too much, They should have fined the hell out of him. Unfortuntly there was a gun involved and big brother does not like us with guns. They come up with more and more laws against guns that only hurt the law abiding citizen. His permit to carry was from Florida and as a permit holder I know some states honor other states permits and some do not, his permit was also expired. Most people do not know this but a license is only to carry it concealed (hidden). IT IS NOT ILLEGAL TO CARRY A FIRE ARM HOLSTERED WHERE EVERYONE CAN SEE IT. You are not allowed to carry a firearm in federal buildings or any building that has a sign posted at the entrance NO FIREARMS ALLOWED. I feel bad for the cat because he was not intending harm or flashing it around or anything like that he just made a stupid mistake and luckily he did not kill anyone. He should have taken a gun safety course before purchasing one to begin with, the gun slipped through his waiste band and went off shooting himself in the leg. That is like those videos you see on TV worlds dumbest people and for that he deserves to be made fun of a little...lol
  People called him PLEXIGLASS for being prone to injury, well now that he is going to prison they will call him FLEXHISASS.

    You sir are an idiot. First of all, Florida has terrible concealed weapon laws. Any idiot can obtain a permit to carry a concealed fire arm. Probably the reason that you were allowed to get one.
    
    New York is a "may-issue" state, meaning they reserve the right to issue concealed weapon permits. However, most of these people are going to be law enforcement, military, or persons of particular wealth and influence. They do not recognize concealed carry permits from other states. Not to mention from states that give concealed weapon permits to any a-hole off the street. His and your ignorance of the law does not change the fact that a law was broken.
    
    Also, New York has a NO OPEN CARRY LAW. Therefore it is unlawful for someone to carry a concealed weapon without a permit, or to carry an open weapon.

  speedwell, that is interesting to know. i think people need to know the laws in each state and education before making comparisons. im not talking about anyone in particular, just saying. and people can we leave race out of the issue? if we did we wouldnt have to deal with it anymore. i do believe 2 years is a lot, considering there are people who do worse things, however, i feel like this no one has the right to complain about presidency unless they voted, well no one has the right to complain about the laws unless they are trying to fix them. there are stories of citizens who have made a difference. maybe YOU can be the next.

  when i talk about the comparisons, i am talking about Vick, Burress, and Stallworth. everyone keeps saying Stallworth got a slap on the wrist, yes he did get off pretty easily. BUT, his situation happened in miami, Burress in NY, and Vick in VA. there are different consequencs in different states. However, Stallworth was completely cooperative from the begining, and footage shows that the man jumped in front of his car, i believe if he was drinking he still would have killed that man, and he wasnt even going that much over the speed limit. Although, I am pro-vick, Vick and company ran a dogfighting operation for about 5 years, and I do believe Vick was less involved but since it was at his house, he got the most punishment.

    kristin, you make a valid point about stallworth. the actions of the victim getting run over are called 'contributory negligence'. it means that if you do something that contributes to your own injury or death (or some other negative consequence), then the party who wrongs you (stallworth) may not be 100% at fault. in this case, i agree that the victim who stallworth killed probably contributed to his own death by running into the street, outside of a crosswalk and from between parked cars. i still think that stallworth's reaction time was affected by alcohol. this is the entire reason why he received a 30 day sentence. comparing this to vick, plax or any other idiot is just the wrong comparison. that kind of logic conveniently leaves out the differences between the situations and only looks at the overall sentence.

  This judicial system does suck, not just with athletes. I know a case where some 18 yr. old chopped some other guys head off because someone gave him $10 and a carton of cigarettes to do it - the guy who did the chopping spent about 20 years in jail and is now out living his life. This guy should not be out of jail.

  The consistency in our judicial system is about as consistent as the NBA refs. Plax was probably never the shapest tool in the shed, but teach him a lesson don't f*ck his life up. The guy has a family. 2 YEARS away from his family. Think about that. I'm not sure what his punishment should have been but I think this is extreme.

    Right, no one has said Plax was smart. BUT who did he hurt? What were his intentions? Was he intending on using the gun on someone else? I'm pretty sure he wasn’t intending on shooting himself. He was probably trying to play up to some image. He went to Michigan State! You don't even have to know your alphabet to go to school there if you are an athlete. Jevon Ringer scored too low to go to Ohio State, which I'm sure the standards aren't very high, but could go to Michigan State. Everyone knows Plax wasn't smart, but two years of your life for not being bright? 2 years of prison love? Could you imagine being a high profile athlete walking into prison?
    
    Some huffy politician, who probably cheats on his taxes, and who probably steals from all the hardworking Americans, campaigned for this guy to get a hard sentence. Our judicial system sucks.

    You have no idea what you are talking about! I guarantee most people who come up on the same charges in NY as Plax who have no prior felony history get less time than Plax got. He made a very stupid decision but the 2 years does not fit the crime. Up to 6 months, heavy fines, and stiff probation would have been fair. I understand why Vick was in jail for 2 years and understand what he learned while in jail but I don't understand what Plax will what more positive he will learn from being in jail for 2 years that he wouldn't have learned in 6 months + FINES+ community service+ irreparable damage to his career and image!

I TOTALLY AGREE that Plax SHOULDN'T have gotten two years because I think it IS excessive for shooting ones self, BUT, I am not against the sentence because A) it is a FELONY OFFENSE, especially in NY where Bloomberg is trying to come down HARD on gun charges, to carry a loaded gun without a permit. B) It is a good wake up call to the rest of these numbnut athletes who think they own the world C) it takes one less idiot off the streets. Ok he didn't shoot anyone else, but that was TOTALLY BY ACCIDENT. That bullet could've went ANYwhere.   And just for the record, your article is concise and well put together. But, at what point do you stop coddling athletes and actors and rappers and Enron C.E.O's? It sends a CLEAR AND DIRECT message that, "you are better than the average person." We are all SUPPOSED to be equal; life, liberty and the pursuit of happiness and all that....why do YOU get all the perks? My cousin is a celebrity; and it used to TRIP ME THE FU*K OUT, how companies used to send BOXES of free clothes to his house, or T-Mobile would send a sidekick 3 months before they came out, or meals were comped or fees waived. It was like as soon as he HAD the money to buy all this crap, they stopped making him pay for it. Not to put his business out in the streets, but he got in trouble with the law, for the same charge, like 7 times, and he walked every time. It went to his head, and he's a douchebag....lol...It sends the wrong message. Maybe these harsh ass penalties will lead to more introspection, which will lead to less incidents, which will lead to less harsh penalties. It has to start somewhere.....

  Plax can afford to pay one of his boys to get trained to be a body guard and to get a concealed weapon license. Just like Stallworth could have caught a cab, or Sir Charles could pay for chauffeur service, or Vick could have played the ponies at the local horse track instead of masterminding an illegal dog fighting ring. Every one of these guys is suffering the consequences of their own actions. Key word: THEIR.

  We all make mistakes - but athletes are in the lime light so their mistakes are more publicized. I'm not taking their side - I think most of them are way overpaid. And I'm still pi**ed off about what happened at a baseball game Tues nite. Stayed late at the Harrisburg Senators game so my kids could get autographs (the Senators are AAA I think, and are in 2nd Last place) and only 1 player out of the 5 or 6 that came out actually smiled and was nice to the kids.

I said leave Vick alone because he served his time and is now on a different path but people still want to crucify him like he got away with his wrong doings. And Plax was dead wrong.   They said that after his two year sentenced when he is released burress will not receive any kind of suspension...so how can they suspend vick? he served a month short of 2 years....he did his time...let em play....why are they even thinkin about a suspension? especially since they said burress isnt gonna receive a suspension in 2011

  Ok, there are MANY different angles and arguments to be made here. Its not as easy as everyone seems to think to be completely fair. To break it down....Is 2 years excessive for Plax's specific incident? IMO, yes. Herein lies the problem/s. It is a WIDELY understood fact among just about all gun owners in the northeastern U.S. (and if you are a gun owner and don't understand this, you should not be allowed to own a gun) that you cannot cross state lines with a handgun, your permit only permits the carrying and use of the gun in the state in which the gun is registered(Plax's piece was registered in FL, not NY, and the Florida permit was actually expired as well, I believe). On top of all of that, everyone in the NE U.S. are aware that in NYC they have extremely strict gun laws and heres the most simple thing of all...A MANDATORY MINIMUM of 3.5 years. That means if your caught with an unregistered piece, you (average person) gets 3 1/2 years no argument, no excuses, thats what a MANDATORY MINIMUM is. Plax, who lives and plays in NY for atleast a good part of the year should be 100% aware of this law and its unrealistic if he were to actually say he wasn't aware. If you buy a gun and live in NY, your aware. So all in all, Plax is actually LUCKY to have gotten 2 years. He technically, according to law, should have an additional 1 1/2 years, and if he were anyone else he most definitely would. So for everyone who is saying he got 2 years just bc of who he is, your right, but in reality hes getting a BREAK, not the hammer. So is it fair that theres a 3.5 year mand. minimum? No. It is an excessive punishment, but an easily avoidable one as well. It's noones fault but his own, he shouldn't have had a gun on him regardless since its obvious he cannot control one and is lucky he didnt take an innocent persons life in the process. Is 2 years too much time IMO for poss of a firearm thats not properly registered? I think so. But in this case, with all of the circumstances it entails, he DID understand what the normal person would get legal wise in his situation, ignored it bc he believed as the star he WAS, that he was invincible and was above the law and could other peoples lives as well as his own in danger while breaking the law and doing as he wished. He took the chance and now is paying the consequences for his mistake.

    Apollokid, I agree 100%, I feel like most of the debate around this issue is centered around the harshness of the law and not the punishment that plax received. IMO, 3.5 minimum for an unregistered weapon is harsh, but then again i don't make the laws or live in NYC, but you better believe if i did, and had a gun I would know what the laws were before I bought it. Last thought, If i was Plax I woulda just hired some big ass jacked bodyguard to follow me around, problem solved

  is it worth him sitting in jail for 2 years if only ONE gun mishap is prevented by this sentence? i think it is, you gotta look at the greater good. i think most athletes (i don't know about gw) are treated differently than everyone else, so they don't have that same societal perspective that the rest of us do. their lifestyle makes them arrogant and they get caught up in their own world.
  you gotta look at the cause and effect of the action, not just the action itself. i think that if a life is saved (and it's very likely that the sentence will potentially save more than 1) then it's worth it.
  in our world it seems like it's everyone for himself, but can't someone just take one for the team like a Fckin man? especially if he put himself in that situation. if he can't nut up take the repercussions, then he belongs in the lingerie football league, not the nfl.

  The dude shouldn't have ran across the street and he wouldn't have gotten hit..... If stallworth didn't have any drinks in him people would only blame the man who ran across a 4 lane highway.....but I don't think him drinking had anything to do with what happened in that situation anyway

    Gee a guy hits and kills a a guy while he is drunk and high, yet you don't think that drugs/alcohol had anything to do with it? I would love to know how you came to that very interesting conclusion, Dr. Monster. How many people have you hit that shouldnt have been walking in the street or in a situation just like Stallworth's? I personally lived in Ft Lauderdale and EVERYONE knows that in that area people notoriously are walking into the street where they shouldnt. People have popped out unexpectedly on me in the same area, yet I manage to be responsible enough to drive at a speed where Im able to stop in a situation like that. I have had more than a handful of incidents of coming close to nailing someone, most coming in the few years I lived in that area. So Stallworth, who lives there was certainly aware of how theres lots of people in that area during all hours of the night. Now maybe if I was high and drunk I wouldnt have been able to dodge those incidents that I had. I would have to say its almost certain that alcohol and or pot played a part in that man's death.
